Perlinski & Associates Inc and its affiliates ("Perlinski & Associates" or "we") provides its content on this Web site (the "Site") subject to the following terms and conditions (the "Terms"). You acknowledge and agree that Perlinski & Associates shall own and have the unrestricted right to use, publish, and otherwise exploit any and all information that you post or otherwise publish on the Site in postings, survey responses, and otherwise, and you hereby waive any claims against Perlinski & Associates for any alleged or actual infringements of any rights of privacy or publicity, moral rights, or rights of attribution in connection with Perlinski & Associates's use and publication of such submissions. You covenant that you shall not post or otherwise publish on the Site any materials that (a) are threatening, libelous, defamatory, or obscene; (b) would constitute, or that encourage conduct that would constitute, a criminal offense, give rise to civil liability, or otherwise violate law; (c) infringe the intellectual property, privacy, or other rights of any third parties; (d) contain a computer virus or other destructive element; (e) contain advertising; or (f) constitute or contain false or misleading statements. Perlinski & Associates does not and cannot review all information posted to the Site by users and is not responsible for such information. However, Perlinski & Associates reserves the right to refuse to post and the right to remove any information, in whole or in part, for any reason or for no reason.
5. Notices of Infringement and Takedown by Perlinski & Associates

8. Governing Law; Jurisdiction
These Terms are governed by the laws of the State of California without reference to the principles of conflicts of laws thereof. Policy on Protection of Consumer Information and Records Perlinski & Associates (“Perlinski”) is a member broker/dealer of the FIRNA and is required to meet the requirements of the SEC Regulation S-P, “Privacy of Consumer Financial Information” (“Privacy Act”).
In part, the Privacy Act requires that each broker/dealer adopt policies and procedures that address the protection of customer information and records.
In order to comply with SEC Regulation S-P, Perlinski & Associates is providing you with this statement regarding its policies on the handling of confidential consumer information. This makes up Perlinski & Associates’ Policy on Protection of Consumer Information and Records.
Perlinski receives confidential information in the course of its business. This includes subscription documents and questionnaires that have been filled out by its investors. These may contain social security numbers, home addresses, annual income, net worth, education background, Employer Identification Numbers and other related data that is essential for Perlinski to have in determining the suitability of the investors.
It is the policy of Perlinski to keep all such records in utmost confidence. It is also Perlinski’s policy not to release such information to any third party. Perlinski has no affiliates who would need or want such information. Perlinski’s employees are initially and continually alerted to the fact that Perlinski obtains confidential information about its investors which must be held in the strictest confidence.
Perlinski does not disclose any non-public personal information about its investors to anyone, except as permitted by law.
Perlinski restricts access to anyone’s personal information to those Perlinski employees who need to know that information to provide products or services to its customers. Perlinski maintains physical, electronic, and procedural safeguards to guard customers’ non-public personal information. These safeguards include keeping all confidential information within premises that are locked or manned at all times, maintaining a strict confidentiality policy, and discussing Perlinski’s confidentiality policies at its company meetings, such as the Annual Compliance Meeting.
